Qld: Lacey brothers' trial set for early 2010

By David Barbeler

BRISBANE, Aug 27 AAP - The sons of a Gold Coast millionaire will stand trial in Brisbane
District Court next February over allegations they made a man dig his own grave before
shooting him in the hand.

Gold Coast brothers Jade, 26, and Dionne Lacey, 22, - the sons of businessman Ken Lacey
- face a string of charges, including torture, assault occasioning bodily harm and deprivation
of liberty.

It's alleged the Laceys abducted Owen Matthews at gunpoint in April 2007 and took him
to an isolated location on South Stradbroke Island, off the Gold Coast, after blaming
him for the loss of 500 ecstasy pills allegedly stolen during a drug exchange.

It's alleged the brothers forced Mr Matthews to dig his own grave and then shot him in the hand.

The trial was adjourned on Tuesday morning at the request of the Laceys' lawyers, who
said new expert evidence had recently come to light.

The brothers' lawyers said they needed more time to explore new lines of inquiry relating
to this evidence, which was not detailed in court.

Prosecutor Michael Byrne accepted the adjournment application.

The case was again mentioned in the Brisbane District Court before Judge Tony Rafter on Thursday.

During the mention, Judge Rafter gave the case a tentative trial date of February 23,
but said both parties would need to confirm this at the next mention on September 11.
